What Is EB3 Visa Category?

If you are a skilled worker, professional, or other worker, you may be qualified for this immigrant visa priority category.

"Skilled employees" are people who work in positions that need at least two years of training or experience and are not temporary or seasonal. The skilled worker must meet the employment opportunity's educational, training, or experience requirements. Training can include relevant post-secondary education.
Persons who are members of the professions and have a job that needs at least a baccalaureate degree from the US.
The "other workers" subcategory is for people who do unskilled labor. They don't need more than two years of training, education, or experience and isn't temporary or seasonal.

Procedure for Submitting an Application

A Form I-140, Immigrant Petition for Alien Workers, must be filed by your employer (petitioner). Your employer must be able to demonstrate a continued ability to pay the promised wage as of the priority date as part of the application process.

If your petition is approved, your spouse and minor unmarried children under the age of 21 may apply for immigrant visas with you. They, too, must fill out the required application forms. They need to pay the fees and submit to medical examinations. Same-sex spouses of U.S. citizens and Lawful Permanent Residents (LPRs) are now entitled to the same immigration advantages as opposite-sex spouses. The same with minor children. Visa Application and Fees

The petition is submitted to the National Visa Center after USCIS accepts it (NVC). The petition will be assigned a case number by the NVC after it has been received. The applicant's case will be pre-processed by the NVC, which will provide information on how to pay the fees. The NVC will request that the applicant provide the relevant immigrant visa documentation. This includes application forms, civil documents, and more after the appropriate costs have been paid.
